Abstract

Based on the Constitutional Court Number 46 /
PUU-VII / 2010, the civil relationship between child
with his father and his father's family based on their
blood relationship between the child and his father
and mother, although the both do not have the
marriage bound. The imperfections of marital
relationship between the father and mother did not
abolish their blood relationship and civil relationship
between a child and his biological father as a civil
relationship between a child and his biological
mother. To find the right meaning of the phrase
“civil relations children nonwedlock with a man as
his father” in the Constitutional Court decision No.
46 / PUU-VIII / 2010, is to observe opinions from
legal experts. Therefore, this discussion is intended
to find answers to the meaning and scope of civil
relations between children nonwedlock with a man
as his father, by analyzing the opinion of a number
of academics and legal practitioners who have
competence in this field.
